NOTICE OF BOND RELEASE
Pursuant to Application Number 807-0372
In accordance with KRS
350.093, notice is hereby given that Nally & Hamilton Enterprises, Inc. P.O. Box 157, Bardstown, Kentucky 40004 has applied for a Phase III Bond Release on Increments 1, 4, 6, 7, 8, 9, 10 and 11, which was last issued July 16, 2018. Increment 1 covers an area of approximately
15.44 acres. Increment 4 covers an area of approximately
18.63 acres of surface area. Increment 6 covers an area of approximately
23.26 acres of surface area. Increment no. 7 covers an area of approximately
26.82 acres of surface area. Increment no. 8 covers an area of approximately
4.19 acres of surface area. Increment no. 9 covers an area of approximately
25.47 acres of surface area. Increment no. 10 covers an area of approximately
45.96 acres of surface area. Increment no. 11 covers an area of approximately
29.11 acres of surface area. The permit area is located approximately
0.25 miles northeast of Balkan in Bell County.
The permit area is approximately
1.74 miles southeast from U.S. 119’s junction with KY 2012 and located 0.5 miles northeast of Tom’s Fork.
The bond now in effect for increment No. 1 is a surety bond in the amount of $24,500. The bond now in effect for increment No. 4 is a surety bond in the amount of $11,400. The bond now in effect for increment No. 6 is a surety bond in the amount of $14,555. The bond now in effect for increment No. 7 is a surety bond in the amount of $17,000, The bond now in effect for increment No. 8 is a surety bond in the amount of $16,300. The bond now in effect for increment No. 9 is a surety bond in the amount of $22,800. The bond now in effect for increment No. 10 is a surety bond in the amount of $40,000. The bond now in effect for increment No. 11 is a surety bond in the amount of $28,200.
Reclamation work performed included: All mining area was backfilled and graded with all highwalls eliminated and the area was seeded; this work was completed in the Fall of 2013.
Written comments, objection and request for a public hearing or informal conference must be filed with the Director, Division of Field Services, 300 Sower Blvd, Frankfort, Kentucky 40601 by November 20, 2026.
A public hearing on the application has been scheduled at 10 AM on November 23, 2026, at the Department for Natural Resources, Middlesboro Regional Office, 1804 East Cumberland Ave., Middlesboro, Kentucky 40965. This hearing will be canceled if no request for a hearing or informal conference is received by November 20, 2026.
