PUBLIC NOTICE

NOTICE OF
TRUSTEE’S SALE OF REAL ESTATE

WHEREAS, by Deed of Trust recorded in the Register’s Office for Claiborne County, Tennessee, in Book 1543, Page 292, on April 3, 2020, Douglas Jeff Warren, Jr., a married man and wife, Jessica Rose Warren conveyed to Joseph G. Coker, Trustee, the hereinafter described real property, to secure the payment of one Promissory Note dated March 30, 2020 in the amount of Three Hundred Ninety Thousand Six Hundred Sixty Dollars and No Cents ($390,660.00) to Home Federal Bank Corporation n/k/a Hearthside Bank Corporation, all as fully set forth in said Deed of Trust and Promissory Note; and
WHEREAS, default has been made in the payment of the above referenced indebtedness, and other provisions of the Trust Deed have been violated, and the legal holder of the Promissory Note secured by the said Trust Deed has declared the entire amount due and payable as provided in said Trust Deed, and the undersigned, as Trustee, has been directed to foreclose the aforesaid Trust Deed in accordance with the terms thereof, and the public is hereby notified that the undersigned Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand, on the front steps of the Claiborne County Courthouse in Tazewell, Tennessee, at 12:00 Noon on April 10, 2026, said property to be sold in bar of the equity of redemption.
Subject lands are set forth as follows:
Tract One (1)
Situated in District No. Six (6) of Claiborne County, Tennessee, and more particularly described as follows:
Beginning point center line of 40 foot right of way in Kyle Campbell Subdivision and in South right of way line of new Tennessee Highway 63; thence with new right of way South 34 deg. 23 min. West 104 feet to right of way monument; continuing with said right of way South 60 deg. 08 min. East 178 feet; thence continuing said right of way Southeast to the center of the aforesaid mentioned of the Kyle Campbell Subdivision; thence with center of said roadway same being the East lines of Lot #9 and 8 in said subdivision Northwesterly direction to the point of beginning.
Tract Two (2)
Situated in District No. Six (6) of Claiborne County, Tennessee, and more particularly described as follows:
Being Tract No. Two (2) of the Kyle Campbell Subdivision to the Town of Arthur, Tennessee as shown on a map of said subdivision recorded in Deed Book 98, Page 53, in the Register’s Office for Claiborne County, Tennessee, but excepting from said Tract No. 2 is a State Highway right of way taken by condemnation for new Highway 63, and said take and map is recorded in Register’s Office for Claiborne County, Tennessee. The tract conveyed contains .49 acres, more or less.
Being the same property conveyed to Douglas Jeff Warren, Jr. from Realty Network, Inc., by Warranty Deed dated March 30, 2020, and recorded in Book 1543, Page 289, in the Register’s Office for Claiborne County, Tennessee, on April 3, 2020
Records in the Property Assessor’s Office for Claiborne County, Tennessee, identify the above described property as follows: Control Map: 29, Parcel: 73.00 (Tract 1) and Control Map: 29, Parcel: 074.00 (Tract 2).
This sale will be free from the equitable right of redemption under the laws of the State of Tennessee, homestead, dower and other exemptions, the same having been waived in said Trust Deed, and will be subject to all unpaid taxes and subject to any easements and restrictions or prior liens or mortgages of record, if any. If the highest bidder is unable to comply with the terms of the sale, I reserve the right to proceed to the next highest bidder able to comply or to re-advertise if I so choose. The right is reserved to adjourn the day of sale to another date and time certain without further publication upon announcement at the time set above. The holder of the Promissory Note shall have the right to bid at said sale.
This property is being sold with the express reservation that the sale is subject to confirmation by the Lender or Trustee. This sale may be rescinded at any time. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, the Trustee or the Mortgagee’s attorney.
The Trustee is aware of a Judgment Lien in favor of Mark Vanscoy against Jeff Warren, Jeff Warren d/b/a Apex Contractor Group and Apex Contractor Group in a case styled “Mark Vanscoy vs. Jeff Warren, Jeff Warren d/b/a Apex Contractor Group and Apex Contractor Group”, File No. 2023-CV-14940 in the General Sessions Court for Claiborne County, Tennessee, entered on July 24, 2023 in the amount of $25,750.00 plus interest at the rate of 10.25% and cost of suit and recorded as a Book 1639, Page 20, in the Register’s Office for Claiborne County, Tennessee on August 7, 2023.
The Trustee is also aware of a Judgment Lien in favor of Joshua Pittman against Jeff Warren a/k/a Douglas J. Warren, Jr. in a case styled “Joshua Pittman vs. Jeff Warren a/k/a Douglas J. Warren, Jr.”, File No. 2024-CV-558 in the General Sessions Court for Claiborne County, Tennessee, entered on June 3, 2024 in the amount of $10,000.00 plus interest at the rate of 10.5% and cost of suit and recorded as a Book 1659, Page 131, in the Register’s Office for Claiborne County, Tennessee on June 24, 2024.
To the best of the Substitute Trustee’s knowledge, information, and belief, there are no further Federal or State tax lien claimants or other claimants upon the subject property which would require notice pursuant to the terms and provisions of T.C.A. § 35-5-104 or T.C.A.§ 67-1-1433 or 26 U.S.C. § 7425.
